    In our view, this is the first text in public law which not only uses the expression “office of the judge” (before the article by R. Chapus and the case law of the summary proceedings of the Council of State under the influence of D. Labetoulle), but moreover, it connects this notion of the office of the judge and that of the “freedom” of the judge in the search for evidence, which clearly demonstrates that the notion of the office of the judge reflects the idea that the judge becomes the guardian of his own powers and duties.
