A comparative analysis reveals that all estate administration, the intermediate phase between inheritance and division, is organized, regardless of the system considered, around a common denominator: the estate, characterized by the allocation of assets to liabilities. Specifically, a kind of natural affinity has emerged between the essentially synthetic notion of the estate and the classical structure of the conflict-of-laws rule, which employs very comprehensive concepts and synthetic categories. Indeed, unlike other methods that only provide a specific, material solution for a given situation, the conflict-of-laws rule is uniquely capable of preserving the coherence of the estate. Therefore, the examination of the law applicable to the administration of estates (Part One) and then of its implementation (Part Two) leads to an elucidation of both the principle and the modalities of the cohesion of the hereditary estate in private international law. In reality, what emerges more generally is the need to establish in international law a specific category of patrimony which itself presupposes the recognition of a “law of patrimony” governing, as such, the realization of liabilities through the entirety of assets.
