It includes, in particular, all the preparatory work carried out both in the 1830s and following the Revolution of 1848 (Dupin, Berryer, Jules Favre), as well as extensive consultations with the most eminent lawyers at the Council of State and the Court of Cassation of the time. These consultations aimed to demonstrate that the decrees ultimately enacted should fall under the jurisdiction of the ordinary courts and that, contrary to the most established jurisprudence of the Council of State, the action for recovery of property could not be subject to a jurisdictional conflict.
