Fideicommissary substitutions aimed to ensure that a person inherited their estate while stipulating that upon their death, the assets would pass to another, also designated, individual. Accepted with reluctance by some customary law communities, this institution was opposed by D'Aguesseau and explicitly prohibited by Article 896 of the Civil Code in the name of equal inheritance rights and to challenge the inheritances of noble families. This text is one of the finest 19th-century works on this subject, containing numerous historical and jurisprudential references.
