8956-toullier-le-droit-civil-francais-1
TOULLIER (C.-B.-M.) – FRENCH CIVIL LAW, ACCORDING TO THE ORDER OF THE NAPOLEONIC CODE

TOULLIER (C.-B.-M.), Paris, 1811-1821, 9 vols. in-8, brown half-morocco with corners, smooth spines decorated with gilt fillets, title pages in fawn calf and volume covers in green calf, (boards rubbed and corners slightly bumped on some volumes, headcaps slightly worn and headcap damaged on vol. VI, some marginal dampstaining), a good set despite the aforementioned defects.

Eugène Gaudemet described Toullier's treatise in these terms: “His work is very different from the commentaries already published in France because, despite a plan subservient to the order of the articles of the Code, it contains a remarkable effort to construct general theories and coherent systems.” It began publication in 1811, and Toullier produced a first edition in eight volumes, completed in 1818. He then published a volume including additions to the previous volumes, while simultaneously undertaking a second, significantly revised edition in eleven volumes (the publication of which was completed in 1823). A second printing was made under the title of the third edition, beginning in 1821. A fourth edition, comprising two additional volumes on marriage contracts, appeared in 1824. A fifth edition, comprising fifteen volumes including a table, was interrupted in 1835 by Toullier's death. This edition was later supplemented by Duvergier in six volumes. A sixth and final edition appeared between 1845 and 1848. Here we have the very rare FIRST EDITION in the first nine volumes, which also includes Toullier's preface to Volume 8. In this preface, he contests his removal from the position of dean of the faculty at Rennes in 1816 on the grounds that "he had inspired in his students sentiments contrary to the legitimate government," a preface that was not included in subsequent editions. Furthermore, Volume 7 bears Toullier's genuine handwritten signature as a mark of authenticity, rather than a stamp as was customary, making it a poignant testament to his work. For all these reasons, our copy is extremely rare and of great interest.
