    This text, drawing particularly on the work of Lombroso, attempts to go beyond it by showing that there is not only an anthropology of the criminal but also a criminological status of the very notion of crime, leading to a definition significantly different from that of jurists, the latter fluctuating according to the evolution of penal laws. Paradoxically, this proposition, which aligns with the theory of social defense, leads in certain cases to the observation of liberal aspects of positive law, and in particular of amnesty and pardon, which arbitrarily call into question convictions. The French edition, prepared by the author himself, differs considerably from the Italian editions.
