(BNF F1705, missing from Berkeley and Cujas). A rare text published by the Holy Inquisition in Valencia, this treatise has two objectives: first, to demonstrate the continuity of custom necessary for it to produce legal effects, and second, to address the law of prescription. It contains the statement of some superb maxims, such as “Ubi cessat ratio, ibi ius” (Quaestio 13, no. 42). Overall, it is a text of high quality of expression that frequently seeks out the theoretical sources of the subject and does not hesitate to refer extensively to legal doctrine. For example, on the authority of legal doctrine (p. 12), the author cites more than 80 clearly identified authors. Certain chapters of these two treatises are quite captivating: see, for example, question 9 on common opinion and public rumor.
