According to Ferrière, it is an “advantage given to one of several contenders over the others, the one who has the strongest claim according to the provisions of the laws.” The text we have is a general theory on the modalities according to which this right of preference should be exercised (see in particular the questions on the right of preference that may arise from custom regarding the order of creditors. Numerous quotations from the great glossators of Roman law, from Baldus to Tiraqueau). It is indisputably a seminal treatise on the subject.
