The final volume in this nine-volume series, this work focuses on contract modifications due to changed circumstances. The series was begun in the early 1970s under the direction of R. Rodière and published as part of a project to develop preliminary drafts for harmonizing business law in the member states of the Common Market. Like all the other volumes in this series, this one begins with a questionnaire followed by national reports from France, Belgium, the Netherlands, Greece, Italy, Germany, England, and Denmark. The subject and content of this volume, compared to the other volumes in the series, warrant some remarks. While the other volumes deal with topics concerning the formation and effects of contracts in general, this volume addresses a rather specific problem within the general theory of contract law. The problem of adapting contracts following a change in circumstances is addressed in relation to the binding force of the contract, within the framework of the effects of contracts in French law, as an aspect of non-performance of obligations and disruptions in the performance of obligations in German law, and within the framework of the doctrine of frustration in English law.
