"Mr. Ladret approaches the problem from the perspective of both a medical expert and a legal scholar. Examining the methods of assessing damages under common law, he first meticulously traces the evaluation process: the expert's role and its limitations, the expert assessment procedure and its ethical framework, the evaluation of the damage, the technical classification and assessment of injuries, the difficulties inherent in these procedures, and current trends in case law regarding compensation, as well as the criticisms that can be leveled against both this case law and Professor Tunc's theory. The author also considers administrative case law concerning compensation for damages caused by administrative activities, observing that while it closely reflects reality, it nevertheless remains significantly less aligned with the general legal framework." In the last two parts, Mr. Ladret examines the special regimes (social security law, war victims' law), following the same path in all cases (expert, expertise, compensation), before concluding at the end of his study that compensation is always insufficient, the techniques and services of experts and judges are questionable, and that in any event, in his opinion, the collectivization of compensation is not desirable.
