“The booklet ‘Mediation, Conciliation, and Arbitration’ comprises the written contributions from the expert seminar held in Paris on September 17 and 18, 2009. This seminar provided the Forum for the Regulation of Social Europe (REGES-Forum) with an opportunity to examine the issue of alternative dispute resolution methods for collective labor disputes in Europe. The book is divided into three parts. The first, general, and introductory part defines mediation, conciliation, and arbitration and situates them within the broader context of international and European labor law. The role of judicial intervention is described as marginal, but essential. The second part compares alternative dispute resolution methods in the law and practice of eight different European countries. The comparison is based on national reports, written according to an identical format. Finally, the third and final part, by way of conclusion, raises the question of whether intervention by the European Union legislature is necessary and feasible.” He also questions the need and advisability of more regulation.
