By the renowned theorist, this fine monograph on the Mandate, which received the Dupin aîné prize, is highly sought after. "PL's thesis has lost none of its substance or intellectual power in 60 years, a power recognized by Gabriel Le Bras from the outset. It comprises two main parts: the first devoted to the sources and major stages of the Curia's understanding of Roman law, and the second, more practical, focusing on the mandate (a private law contract used by public ecclesiastical law). His thesis forms the foundation of his entire work and constitutes the guiding thread of his thought on the origins of law, the State, and the judicial system, all of which are characteristic of Western civilization. PL is a figure whose thought defies categorization within the classical disciplines. He escapes all labels. He is fundamentally a poet, an artist who closely studied medieval texts that made use of Roman and canon law, texts at the source of all subsequent knowledge." He delved into the intricacies of language and the categories governing the development of thought, and thus of rationality, in the West. The published 146-page thesis is a condensed version of the initial work of over 600 pages presented to a jury composed of Messrs. Le Bras, Dumont, and Gaudemet. The thesis's foreword reads: "Yielding to the friendly insistence of my mentors and the reasoning of those I have served, I have decided to produce a printed edition, primarily intended to assist non-specialists who wish to learn the essentials, through a simple introduction, of the problematic nature of the two legal systems at a time when they were to acquire a new form of equilibrium. Viewed in this light, this thesis will prove useful, as its primary aim is to establish an inventory of the problems. Therefore, no changes to the text were considered; only the exposition has been abridged in several places." This is therefore not a dusty, worn, outdated work. On the contrary, it is one of the major sources of his inspiration. It is among the greatest and most beautiful legal theses that are now out of print and impossible to find.
