Substitution is the legal act by which the holder of an estate substitutes a third party for the appointed heir, who is called upon to receive the property should the appointed heir die before the testator, or appoints an heir with the obligation to transmit the property to a specific and identifiable third party (this is the fidei commissarius substitution). This institution was extremely widespread in the Middle Ages, but in the 16th and 17th centuries it encountered questions raised by natural law, particularly regarding whether the freedom to make a will was a natural right. This resulted in serious controversies, and one of Chancellor D'Aguesseau's principal ordinances was precisely to bring order to the jurisprudential divergences that had emerged.
