    "Presenting Dr. Jean Penneau's thesis is a difficult task. This important work, written by a general practitioner, fills nearly four hundred pages. Published in the "Library of Private Law" series, it stands out both for the originality of its subject matter and the wealth of documentation gathered, whether from legal doctrine or case law. In the first part, the author endeavors to distinguish between fault and error—an essential task in the eyes of the jurist. If one succeeds in clearly defining a boundary between the two, the choice of what should or should not give rise to legal action will be greatly facilitated. To support his argument, Mr. Penneau has compiled a substantial bibliography, which he comments on extensively. (...) The author deserves credit for drawing attention to the problem and for explaining it in an engaging discussion." Starting from the distinction between fault and error, Mr. Penneau observes that there is an area in which the harmful consequences of a medical act are not compensated. He finds this situation difficult to accept. It leads him to propose a system of automatic compensation for abnormal damages caused by medical acts, financed by a guarantee fund.
