in-8, half green calf (slightly sunned) with corners, author and title gilt on spine with 5 raised bands, top edges gilt, covers preserved, very good condition except for a few rare scuffs, joints slightly marked and edges rubbed, [this thesis comes from the personal library of Henry Solus with an AUTHOR'S INSCRIPTION TO HENRY SOLUS], XV-504 p.
This thesis “is currently the most well-documented work on this important question. (…) The work naturally comprises two parts: 1. The intention to manage another's affairs. 2. The utility of management. In the first part, it demonstrates the ambiguity of case law, which sometimes recognizes the management of another's affairs even when there was not even a probable intention to manage them, and in the second, the opposition between “subjective and original utility in disinterested management” and “objective and ultimate utility in self-interested management.” The formulations are apt; unfortunately, moreover, because this is a sign that case law (and sometimes legal scholarship) is overstepping the bounds of the institution. But this is not the author's fault, who must acknowledge the fact.” (René Rodière, in RIDC no. 2/1973, p. 439).
