in-8, half green calf (slightly sunned) with corners, author and title gilt on spine with 5 raised bands, top edges gilt, covers preserved, very good condition except for a few rare scuffs, joints slightly marked and edges rubbed, [this thesis comes from the personal library of Henry Solus with an AUTHOR'S INSCRIPTION TO HENRY SOLUS], IV-412 p.
Published in the private law library of Mr. Solus, to whom we owe so many excellent titles, and preceded by a solid and subtle preface by Mr. Pierre Catala, this work fills […] a gap in our legal literature. It is divided into two parts. The first, “The Scope of the Obligation,” itself comprises two sections: “Delivery of the Object” and “Respect for the Conformity of the Object.” The second, “Litigation of the Obligation,” is itself divided into two sections: “Choice of Applicable Law” and “Available Solutions.” The work is interesting from beginning to end; it is peppered with very sound analyses (for example, on the different meanings of the scope of obligation in specific goods and in generic goods (no. 37), although the nuances attached to each of the two meanings are not sufficiently indicated), and with judicious common-sense remarks (for example, on specific performance, no. 185, or on the coercive scope of agreed deadlines, nos. 28 et seq.). [René Rodière in RIDC no. 2/1973, pp. 435-436] We deduce from the "cut" pages that these are the passages that attracted J. Carbonnier's attention: pp. 1-84 and 365-412.
