“[The author], in an original and engaging thesis, has not only focused on the punitive aspect of criminal law in the context of contract formation. He has also emphasized the “deterrent” influence of criminal law, the existence of which plays a significant role in the very choice of contracts adopted by individuals, in the drafting of their clauses, and thus seriously limits the scope of freedom of contract. Criminal law, through the fear it inspires in contracting parties, shapes the very content of contracts and has a normative value over civil contracts. [The author] examines the influence of criminal law in two directions: first, on the protection of the parties’ consent, and second, on the protection of the public interest. [...] Through specific cases, which are not developed for their own sake but rather as signs of changes or developments, he offers us a book of legal philosophy.” [A. Chavanne, RIDC, 1971, no. 23-1, p. 10] 268-269].
