The entire Roman law community was well aware of the limitations of this outdated translation, but no one ever considered undertaking a complete rewrite, given the considerable difficulty and scope of the task. We owe it to Dominique Gaurier, a legal historian and Roman law scholar, for having the courage to undertake a translation of all fifty books of the Digest, this encyclopedic work on classical Roman law literature, compiled at the request of Emperor Justinian in the 6th century, through which he intended to restore the Latin legal tradition. In this work, he presents us with what is undoubtedly one of the most ambitious projects in contemporary legal publishing. This translation rests on several premises. First, the translation takes into account the profound changes that have occurred in the understanding and approach to Roman law, which is now presented not as a theoretical system, but rather as entirely casuistic. Thus, the proposed translation aims to allow both historians and jurists to approach this text with a fresh perspective by returning to the understanding of law shared by the jurists of the classical period. Second, it seeks to present a rigorous approach, systematically translating all idiomatic expressions of Roman law to facilitate comprehension, and also closely following the development of thought as expounded by Roman jurists, without reducing it to an expression that might be found in our Civil Code or modern legal doctrine. Finally, readers of this translation, made by a single author, as was Hulot's in 1803, will find a coherence maintained throughout the work.
