This is the thesis that A. Viala wrote during his captivity in Oflag No. XVIII. This text is of twofold interest. The first, obviously, lies in its historical and social analysis of the rise of the National Socialist Party, approached from the three perspectives of political events, the economic situation, and collective ideologies and passions. The second interest lies in its legal approach; the author “shows us German legal technique grappling with Hitlerian myths,” and in particular the “flexibility” or “contortionist” of German jurists in justifying the “re”-conversion of legal rules to National Socialism.
