Pothier's works were the subject of several scholarly re-editions in the 19th century (Bugnet in 10 vols. 1845-1848; Siffrein 19 vols. 1921-1922; Berville 26 vols. 1820; Dupin 11 vols. 1824-1825; Firback and Rogron 2 vols. 1825; Dabot jeune 19 vols. 1925 as well as an anonymous edition in 13 vols. in-8 or 7 vols. in-4 in 1807-1820). Ours, therefore, is the first, written at the height of Pothier's influence, so evident in the drafting of the Civil Code, and it expresses this influence perhaps better than any other text. Indeed, Pothier's texts are presented here through notes, additions, and even nearly complete treatises, relating them to the provisions of the new Code, and it is clear that the authors aimed to establish Pothier as the first author of a treatise on the Napoleonic Code. The quality of the notes (which correct imperfections in the text and even compare Pothier's text with that of other ancient authors on the same subjects), the value of the forewords at the beginning of each volume, which often provide a critical or historical perspective on each topic, and the caliber of the authors—Hutteau, who began as a lawyer at the Parliament of Paris and then as a judge at the Civil Court of the Seine, was also mayor of the 5th arrondissement under the name Hutteau d'Origny; Bernardi, head of civil legislation at the Grand Judge's office, was also the author of the first course on the Civil Code published in 1803 (Cours de droit civil français ou Recueil de maximes fondamentales de la jurisprudence actuelle, Paris, 4 vols., 1803-1804), and he was also instrumental in the revival of legal studies under the Consulate as a professor at the University of Jurisprudence—all these factors combine to make this edition the preferred one among modern reprints of Pothier's work. Furthermore, our copy is complete with a 23rd volume containing the Insurance Contract, followed by a modern treatise on the subject by Estrangin, which is probably the first work on the topic after the adoption of the Civil Code.
